This Privacy Policy describes how NEXA Health, a Florida nurse registry operating under its registered fictitious name, with its principal place of business at 21314 Sonesta Way, Boca Raton, Florida 33433 (“NEXA,” “we,” “us”), collects, uses, shares, and protects personal information when you visit our websites, use our platform, request or receive home care services, or apply to receive referrals as a health care professional (collectively, the “Services”). Our Services are offered in Florida.

1. Information We Collect

Information you provide. Depending on how you use the Services, this may include:

  • Contact and account information — name, email, phone number, address, login credentials, and, where applicable, the name and relationship of a family member or representative acting for a care recipient.
  • Care and health information (clients) — information about the care recipient’s conditions, needs, activities of daily living, medications, home environment, emergency contacts, and care preferences, collected to arrange appropriate referrals.
  • Professional information (providers) — licenses and certifications, work history, references, training records, background screening information (processed with screening vendors as required by Florida law), tax identifiers needed for payouts, and recorded video interviews.
  • Payment information — payments are processed by Stripe; we receive limited billing details (such as card brand and last four digits) but do not store full card numbers.
  • Communications — messages, feedback, and support requests you send us.

Information collected automatically. Device and browser information, IP address, log data, pages viewed, and information collected through cookies and similar technologies. We use essential cookies to operate the Services (such as keeping you signed in) and may use analytics cookies and similar tools to understand how the Services are used. We also record the date, time, IP address, and device information when you electronically sign agreements, as part of the signature audit trail.

Location information (providers). When providers clock in and out of shifts, we collect GPS location at those moments to verify visits. We do not continuously track location.

2. How We Use Information

  • To operate the Services: matching and referring caregivers, scheduling, dispatch, visit verification, billing, and payouts.
  • To verify provider credentials and background screening eligibility as required of a nurse registry under Florida law.
  • To communicate with you about the Services (see Section 4 for text messaging).
  • To use automated tools, including artificial intelligence services, to help evaluate applications, match care needs with caregiver qualifications, and summarize information. Significant decisions — such as provider acceptance and client-caregiver approval — may involve human review.
  • To maintain safety and quality, investigate concerns, and enforce our agreements.
  • To comply with law, including AHCA requirements, record retention, mandatory reporting, and emergency management coordination.
  • With your consent, to send occasional marketing communications, which you can opt out of at any time.

3. How We Share Information

  • Between clients and caregivers — we share the information each needs to evaluate and carry out a care engagement (for example, a caregiver’s credentials and profile with a client, and a client’s care needs, address, and schedule with a referred caregiver, who is contractually required to safeguard it).
  • Service providers — vendors that process data for us, such as hosting and database services, payment processing (Stripe), messaging (SMS and email providers), video services, background screening vendors, and AI processing services, each bound to use the data only to provide their service.
  • Legal and safety — regulators (including AHCA), law enforcement, courts, and emergency management authorities where required by law or necessary to protect health and safety.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.

We do not sell personal information, and we do not share personal information with third parties for their own marketing or cross-context behavioral advertising.

4. Text Messaging

By providing your mobile number, you consent to receive service-related text messages from NEXA (such as scheduling updates, onboarding links, and verification codes) and, where you have agreed, occasional marketing texts. Consent to marketing texts is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time and HELP for help, or contact privacy@nexahc.com. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with any third party.

5. Health Information

We treat health and care information with heightened safeguards: it is encrypted in transit and at rest as appropriate, access is limited to personnel and caregivers who need it to arrange or deliver care, and access is monitored. Caregivers referred through NEXA are independent contractors and are contractually obligated to protect client information and to comply with applicable privacy laws in their handling of it.

6. Security

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encryption in transit and at rest, access controls, and monitoring. No method of transmission or storage is completely secure; if we learn of a breach affecting your information, we will notify you as required by law, including the Florida Information Protection Act.

7. Retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations (including health care record retention requirements applicable to nurse registries), resolve disputes, and enforce agreements. When information is no longer needed, we delete or de-identify it.

8. Your Choices and Rights

You may access and update much of your information through your account. You may request access to, correction of, or deletion of your personal information by contacting privacy@nexahc.com; we will honor requests except where retention is required by law (for example, signed agreements, care records, and audit trails). You can opt out of marketing at any time (STOP for texts, unsubscribe links for email) and control cookies through your browser settings.

9. Children

The Services are not directed to individuals under 18, and we do not knowingly collect personal information from children except information about a care recipient provided by an authorized adult. If you believe a child has provided us personal information, contact privacy@nexahc.com and we will delete it.

10. Changes to This Policy

We may update this Policy from time to time. Material changes will be posted with a new version number and effective date, and where appropriate we will notify you through the Services or your contact information on file. Your continued use of the Services after the effective date constitutes acceptance.
